(AP) ? The dispute over the future of "The Godfather" franchise is moving to federal court in Manhattan as Paramount Pictures and heirs of the story's author face off at a hearing Thursday.

The son of "The Godfather" creator Mario Puzo wants a judge to end Paramount's rights to make future "Godfather" films.

Lawyers for Anthony Puzo said in court papers that the company breached its contract when it tried in December to stop publication of "The Family Corleone," a "Godfather" sequel that was published in May.

Paramount, which is owned by Viacom Inc., sued the late author's estate in March, seeking a declaration that it automatically owned book publishing rights in any book that was a sequel to "The Godfather." Paramount said in court papers that in 1969, it purchased from Puzo all rights and copyright interests in "The Godfather," including all "literary" rights and rights to use any characters created for the story in "other works." Mario Puzo died in 1999.

Paramount said the only right left to the Puzo estate was the right to publish the original novel "The Godfather" and to publish versions and adaptations.

But the estate's lawyers disagree. They said the agreement excluded book publication rights from the rights that Paramount could acquire.

They said Paramount also got nasty in trying to prevent publication of the new sequel by contacting the publishers of the book and insisting that neither the publishers nor the estate had any right to publish it.

The estate asked the court to declare that the estate owns the book publishing rights to any sequel, that Paramount cannot prevent the estate from publishing the book and that Paramount does not automatically have film rights to new books.

"The rights repudiated and violated by Paramount were of fundamental and critical importance to Puzo and were of the essence of the 1969 agreement," the lawyers wrote. "More than once, Puzo said, 'Books are my world,'" explaining why Paramount didn't get book rights and wouldn't get them."

Human and soil bacteria swap antibiotic-resistance genes

ScienceDaily (Aug. 30, 2012) ? Soil bacteria and bacteria that cause human diseases have recently swapped at least seven antibiotic-resistance genes, researchers at Washington University School of Medicine in St. Louis report Aug. 31 in Science.

According to the scientists, more studies are needed to determine how widespread this sharing is and to what extent it makes disease-causing pathogens harder to control.

"It is commonplace for antibiotics to make their way into the environment," says first author Kevin Forsberg, a graduate student. "Our results suggest that this may enhance drug resistance in soil bacteria in ways that could one day be shared with bacteria that cause human disease."

Among the questions still to be answered: Did the genes pass from soil bacteria to human pathogens or vice versa? And are the genes just the tip of a vast reservoir of shared resistance? Or did some combination of luck and a new technique for studying genes across entire bacterial communities lead the scientists to discover the shared resistance genes?

Humans only mix their genes when they produce offspring, but bacteria regularly exchange genes throughout their lifecycles. This ability is an important contributor to the rapid pace of bacterial evolution. When a bacterial strain develops a new way to beat antibiotics, it can share the strategy not only with its descendants but also with other bacteria.

Earlier studies by other scientists have identified numerous resistance genes in strains of soil bacteria. However, unlike the seven genes described in this report, the earlier genes were dissimilar to their analogs in disease-causing bacteria, implying that they had crossed between the bacterial communities a long time ago.

Most of the antibiotics used to fight illness today originated from the soil. Bacteria use the antibiotics, in part, as weapons to compete with each other for resources and survival. Scientists have long acknowledged that gives environmental bacteria an evolutionary incentive to find ways to beat antibiotics.

"We wanted to try to get a broader sense of how often and extensively antibiotic-resistance genes are shared between environmental bacteria and pathogens," says senior author Gautam Dantas, PhD, assistant professor of pathology and immunology.

The researchers isolated bacteria from soil samples taken at various U.S. locations. The bacteria's DNA was broken into small chunks and randomly inserted into a strain of Escherichia coli that is vulnerable to antibiotics. Scientists treated the altered E. coli with multiple antibiotics.

"We knew that any E. coli that continued to grow after these treatments had picked up a gene from the soil bacteria that was helping it fight the antibiotics," Forsberg says.

Scientists took the DNA from soil bacteria out of the surviving E. coli and prepared it for high-throughput sequencing. Dantas' laboratory has developed techniques that make it possible to simultaneously sequence and analyze thousands of chunks of DNA from many diverse microorganisms. The DNA can be selected for a single function, such as antibiotic resistance.

When the scientists compared antibiotic-resistance genes found in the soil bacteria to disease-causing bacteria, they were surprised to find some genes were identical not only in the sections of the genes that code for proteins but also in nearby non-coding sections that help regulate the genes' activities.

Since bacteria have such large population sizes and rapid reproduction times, their DNA normally accumulates mutations and other alterations much more quickly than the DNA of humans. The lack of changes in the resistance genes identified in the study suggests that the transfers of the genes must have occurred fairly recently, according to Dantas.

In some soil bacteria, the genes are present in clusters that make the bacteria resistant to multiple classes of antibiotics, including forms of penicillin, sulfonamide and tetracycline.

"I suspect the soil is not a teeming reservoir of resistance genes," Dantas says. "But if factory farms or medical clinics continue to release antibiotics into the environment, it may enrich that reservoir, potentially making resistance genes more accessible to infectious bacteria."

Japan court rejects Apple patent claims against Samsung

A Japanese court Friday rejected Apple's claim that Samsung stole its technology, dealing a blow to the iPhone maker after last week winning $1.05 billion in damages in the US from its bitter rival.

The ruling by the Tokyo District Court is the latest chapter in a long-running global patent war between the smartphone giants who have accused each other of stealing intellectual property for their own products.

The Japanese court found that Samsung did not infringe on Apple's iPhone and iPad patents for some of its own Galaxy smartphones and tablet computer. The three-judge panel also awarded legal costs to Samsung.

"The defendant's products do not seem like they used the same technology as the plaintiff's products so we turn down the complaints made by (Apple)," Judge Tamotsu Shoji told the court.

Apple had sought damages and the block of sales of its some of Samsung's products in the lucrative Japanese market.

But as well as dealing a blow to the US firm, the ruling will help Samsung pick itself up after the defeat in the United States, analysts said.

Samsung shares closed 1.48 percent higher in Seoul on Friday.

"Investors were encouraged by the ruling in Tokyo... it eased concern over Samsung's future which had been raised by the defeat in the US court battle," said Seo Won-Seok, analyst at Korea Investment Securities.

Samsung, which has steadfastly denied its rival's claims in a string of similar cases filed across the globe, hailed the Tokyo court's ruling.

"We welcome the court's decision, which confirmed our long-held position that our products do not infringe Apple's intellectual property," it said in a statement.

A Japan-based spokesman for Apple, which can appeal the verdict, declined to comment.

Last week the iPhone maker won $1.05 billion in a massive US court victory over Samsung with jurors finding that the South Korean firm had "willfully" infringed on Apple's patents.

The Japanese case, which focused on Apple's claim that Samsung stole technology used to transfer music and video files, sought a comparatively small amount -- 100 million yen ($1.27 million) -- in damages.

Both firms' gadgets are increasingly popular in the the Japanese market which was previously monopolised by domestic giants such as Sony and Sharp.

"It was a ruling on just one technology so it is difficult to draw any conclusion on its overall impact," said Michiru Takahashi, a patent lawyer at Jones Day in Tokyo.

"But... if Samsung had lost again it would have considerably hurt its image."

The high-profile verdict in the United States last week regarded patents on a range of Samsung products including some of its popular smartphones and its Galaxy 10 tablet.

Jurors rejected the South Korean electronics firm's patent theft counterclaims against Apple.

Also last week, a court in Seoul ruled the pair had swiped each other's technology and awarded damages to both sides.

The Seoul Central District Court said Apple breached two of Samsung's technology patents, and ordered it to pay 40 million won ($35,000) in damages.

It also ordered Samsung to pay 25 million won for violating one of Apple's patents. Each company had sought damages of 100 million won from the other.

The South Korean court said there was "no possibility" that consumers would confuse Samsung and Apple smartphones -- a key issue in the US trial -- and that Samsung's smartphone icons do not infringe Apple's patents.

But it said Samsung infringed Apple's patent for bounce-back technology, a widely copied spring-back action when users reach the edge of a document.

The court imposed a partial ban on both firms' product sales.

The patent cases come as Apple loses ground to rivals including Samsung that use the Android operating system developed by Google.

Samsung shipped 50.2 million smartphones globally between April and June, while Apple sold 26 million iPhones, according to research firm IDC.

The Asian firm held 32.6 percent of the market compared to 16.9 percent for Apple, while the US company holds about a 70 percent market share for tablets.

Sure, it does get a number of bad reps (heart disease, cancer,?blablablah), and doctors won't spesifically prescribe you a hot macchiato when you do your medical checkup, but in the time where everything contradicts everything, studies found out that coffee is?actually?beneficial for your health.

PROS:
Really? Yes, according to many studies. The nutritions inside coffee can lower the risk of Parkinson disease, protect the body from cellular damage (because of the antioxidants from the plant phenols in coffee), prevent tumors, and obviously, increase clarity and focus (that's why some people must get coffee when they're working overnight;?moi, if i drink coffee in the afternoon, i assure you i won't sleep early).

CONS:
So coffee is good. BUT--yes, there's a but--if you take it in moderation. Two to three cups a day is enough. If you take more, maybe like 5 cups, it's possible that you will suffer from heart failure and high blood pressure (explains why you're so cranky?). When you're on medication, it's also best if you don't consume any coffee because it might 'disturb' the treatment. And notice that your heart is pumping more after you take a cup of coffee? Imagine if you do it 5 times a day or more. Give your heart a break, man.

The good thing about coffee is that it only contains around 2 calories in a cup! Oh, gosh, that's a tiny number, what a beautiful day! Don't get so happy now, because that is only for brewed coffee, without--and note this--added sugar, artificial sweetener, syrup, and other good stuffs. Yes, even milk. So never ever consider that you're making a healthy choice, never ever think that you're increasing your antioxidants, releasing all those pollutants from your body, and lowering Parkinson risk, if what you order is a Starbucks Venti Java Chip Frappuccino with whipped cream. All those health benefits are gone, or at least clouded, by the whopping calories and all those ingredients inside (the latter has 460 calories--equivalent to a whole lunch meal!).
I'm not suggesting that you should avoid going to Starbucks (my family can't stop going to Starbucks) or any other coffee shops (heck, i love coffee shops!), but beware because they will offer you some fancy offerings (it's what keeps the business going anyway). Here are some tips:
  • Only order brewed coffee. Simple names like "Caffe Misto", "Iced coffee", even "Cappuccino" and "Latte" are still allowed.
  • Please stop craving those Frappuccinos. It's little coffee blended with much milk, sugar, and syrup. You don't need that! But if you must...
  • Hold everything the coffee shop allows you to hold. Hold the whipped cream, choose nonfat or 2% milk (don't opt for soy--other than it'll cost you more, it'll 'tweak' the taste and soy milk doesn't really make any difference to the calories), ask if there's a healthier choice of syrup, ask for less syrup, ask for less sugar, ask for less anything and you'll save up to 200 calories.
  • One important thing that people likes to forget is size. People, size does matter. You don't need a Venti-sized latte. Seriously, all you need is a little 'cup of coffee'. Don't exaggerate. Don't be American (sorry). Be frugal. I personally suggest to ask the waiter for the smallest size. Starbucks is a little bit tricky. They always ask you, "Grande or Venti?". It looks like there are only 2 options, but no, you can order for "Tall", which is a small but really enough cup. I always order that.
  • If all else fails... Well, if you still want that holiday-exclusive Peppermint blended beverage, share with a friend. It'll save up many calories. And oh God i can't believe i have to remind you again: HOLD THE WHIP.

ScienceDaily (Aug. 23, 2012) ? Scientists at the University of Houston (UH) have discovered what may possibly be a key ingredient in the fight against Parkinson's disease.

Affecting more than 500,000 people in the U.S., Parkinson's disease is a degenerative disorder of the central nervous system marked by a loss of certain nerve cells in the brain, causing a lack of dopamine. These dopamine-producing neurons are in a section of the midbrain that regulates body control and movement. In a study recently published in the Proceedings of the National Academy of Sciences (PNAS), researchers from the UH Center for Nuclear Receptors and Cell Signaling (CNRCS) demonstrated that the nuclear receptor liver X receptor beta (LXRbeta) may play a role in the prevention and treatment of this progressive neurodegenerative disease.

"LXRbeta performs an important function in the development of the central nervous system, and our work indicates that the presence of LXRbeta promotes the survival of dopaminergic neurons, which are the main source of dopamine in the central nervous system," said CNRCS director and professor Jan-?ke Gustafsson, whose lab discovered LXRbeta in 1995. "The receptor continues to show promise as a potential therapeutic target for this disease, as well as other neurological disorders."

To better understand the relationship between LXRbeta and Parkinson's disease, the team worked with a potent neurotoxin, called MPTP, a contaminant found in street drugs that caused Parkinson's in people who consumed these drugs. In lab settings, MPTP is used in murine models to simulate the disease and to study its pathology and possible treatments.

The researchers found that the absence of LXRbeta increased the harmful effects of MPTP on dopamine-producing neurons. Additionally, they found that using a drug that activates LXRbeta receptors prevented the destructive effects of MPTP and, therefore, may offer protection against the neurodegeneration of the midbrain.

"LXRbeta is not expressed in the dopamine-producing neurons, but instead in the microglia surrounding the neurons," Gustafsson said. "Microglia are the police of the brain, keeping things in order. In Parkinson's disease the microglia are overactive and begin to destroy the healthy neurons in the neighborhood of those neurons damaged by MPTP. LXRbeta calms down the microglia and prevents collateral damage. Thus, we have discovered a novel therapeutic target for treatment of Parkinson's disease."

The difference here is, if you click the link on Facebook, it won't take you out of the social network's gated community ? at least for now. Instead, you'll be directed to the company or product's home on Facebook. For example, click the "Sponsored" ad for Match.com, and you''ll find yourself on Match.com's Facebook page, not the online dating website itself.

The "Sponsored" results are fairly unobtrusive in their current form, and clearly labeled as advertisements. That's important. Nobody's tricking you into?you click on them.

If you're wondering why even more advertisements are necessary on Facebook, with or without its plummeting IPO, remember the words of Sen. Tom Cruise and Katie Holmes' five-year marriage is officially over.

The couple's divorce case?was closed on Monday after a New York judge signed off on the final judgment, according to court records obtained by E! News.

The news comes just a month-and-a-half after the 33-year-old Holmes shocked the world by filing for divorce?from her 50-year-old "Top Gun" hubby and seeking sole custody of their 6-year-old daughter, Suri. The twosome formerly known as TomKat entered negotiations almost immediately and worked out a settlement?in a matter of days, the details of which remained confidential.

A source close to Cruise tells E! News today that the actor is please that he is moving on from the divorce.

"Tom is very happy and relieved that he is moving forward," says the source, who's familiar with the terms of the deal. "His priority is being a good father and this settlement will make sure that continues."

Cruise and Holmes began dating in April 2005 and a month later the "Mission: Impossible" star proclaimed his love for the actress with his infamous Oprah Winfrey couch-jumping appearance. The pair tied the knot?in Nov. 2006 in a lavish ceremony in Italy.

Frommer's travel guide company acquired by Google | San Jose ...

Well-known travel guide publisher Frommer's has been acquired by Google Inc., according to the San Jose Business Journal.

The price of the business acquisition remains confidential.

Last September of last year Google acquired the restaurant and travel guide publisher Zagat. Commentators stated that they expected that Google may now move to merge Zagat and Frommer's.

Frommer's has published 350 travel guides. They are arranged in 14 different series. Books in the company's back catalog include guides to national parks in the U.S., the "For Dummies" series of guidebooks, and a series of "Day by Day" guides designed to help tourists navigate through various popular travel destination cities. Frommer's also presents information about over 3,500 tourist destinations around the globe on its travel website.

The company started small but quickly grew in popularity after it published "Europe on $5 a Day" by Arthur Frommer in 1957. Frommer had done much of the initial research while serving in the military and trying to assist GIs stationed in Europe who wanted to see the sights in the countries nearby without it costing an arm and a leg.

Frommer's publisher has been John Wiley & Sons Inc. Wiley reportedly now wants to focus on scientific, professional, and technical publications, and its sell off of Frommer's may be only the first in a series of sales of media companies which no longer fit within its new focus.

US deaths in Afghanistan hit 2,000 in 'forgotten' war

KABUL, Afghanistan --?It was once President Barack Obama's "war of necessity." Now, it's America's forgotten war.

The Afghan conflict generates barely a whisper on the U.S. presidential campaign trail. It's not a hot topic at the office water cooler or in the halls of Congress ? even though more than 80,000 American troops are still fighting here and dying at a rate of one a day.

Americans show more interest in the economy and taxes than the latest suicide bombings in a different, distant land. They're more tuned in to the political ad war playing out on television than the deadly fight still raging against the Taliban. Earlier this month, protesters at the Iowa State Fair chanted "Stop the war!" They were referring to one purportedly being waged against the middle class.


By the time voters go to the polls Nov. 6 to choose between Obama and presumptive Republican nominee Mitt Romney, the war will be in its 12th year. For most Americans, that's long enough.

'Bumper sticker deep'
Public opinion remains largely negative toward the war, with 66 percent opposed to it and just 27 percent in favor in a May AP-GfK poll. More recently, a Quinnipiac University poll found that 60 percent of registered voters felt the U.S. should no longer be involved in Afghanistan. Just 31 percent said the U.S. is doing the right thing by fighting there now.

Not since the Korean War of the early 1950s ? a much shorter but more intense fight ? has an armed conflict involving America's sons and daughters captured so little public attention.

"We're bored with it," said Matthew Farwell, who served in the U.S. Army for five years including 16 months in eastern Afghanistan, where he sometimes received letters from grade school students addressed to the brave Marines in Iraq ? the wrong war.

More than ten years after the beginning of the war, Afghanistan faces external pressure to reform as well as ongoing internal conflicts.

"We all laugh about how no one really cares," he said. "All the 'support the troops' stuff is bumper sticker deep."

Farwell, 29, who is now studying at the University of Virginia, said the war is rarely a topic of conversation on campus ? and he isn't surprised that it's not discussed much on the campaign trail.

"No one understands how to extricate ourselves from the mess we have made there," he said. "So from a purely political point of view, I wouldn't be talking about it if I were Barack Obama or Mitt Romney either."

Ignoring the Afghan war, though, doesn't make it go away.

According to the defense department's latest tally (updated on August 21, 2012 at 10 a.m. ET), 1,972 Americans have died in Afghanistan since President George W. Bush launched attacks there in October 2001 to rout al-Qaida.

The terrorist group used Afghanistan to train recruits and plot the Sept. 11 attacks that killed nearly 3,000 Americans.

If casualties in other countries are included, the number of Americans killed since the start of the war is 2,091.

According to an analysis of U.S. forces killed in the war by The New York Times, three out of four who died were white, nine out of 10 were enlisted service members and the average age of those who died was 26. Half of the deaths were in Afghanistan's Kandahar or Helmand provinces?? in the country's Taliban-dominated south, the Times reported.

The war drags on even though al-Qaida has been largely driven out of Afghanistan and its charismatic leader Osama bin Laden is dead ? slain in a U.S. raid on his Pakistani hideout last year.

Strangely, Afghanistan never seemed to grab the same degree of public and media attention as the war in Iraq, which Obama opposed as a "war of choice."

Unlike Iraq, victory in Afghanistan seemed to come quickly. Kabul fell within weeks of the U.S. invasion in October 2001. The hardline Taliban regime was toppled with few U.S. casualties.

But the Bush administration's shift toward war with Iraq left the Western powers without enough resources on the ground, so by 2006 the Taliban had regrouped into a serious military threat.

Candidate Obama promised to refocus America's resources on Afghanistan. But by the time President Obama sent 33,000 more troops to Afghanistan in December 2009 in a policy known as the "surge", years of war in Iraq and Afghanistan had drained Western resources and sapped resolve to build a viable Afghan state.

Army casualties during the surge were heaviest at Fort Campbell in Kentucky (home to the 101st Airborne Division) and Fort Drum in New York (home to the 10th Mountain division), according to the Times' analysis of deaths. Units at both bases were frequently deployed to Afghanistan during the surge, the Times reported.

Over time, Obama's administration has grown weary of trying to tackle Afghanistan's seemingly intractable problems of poverty and corruption. The American people have grown weary too.

While most Americans are sympathetic to the plight of the Afghan people, they have become deeply skeptical of President Hamid Karzai's willingness to tackle corruption and political patronage and the coalition's chances of "budging a medieval society" into the modern world, says Ann Marlowe, a visiting fellow at the Hudson Institute, a policy research organization in Washington.

"With millions of veterans home and talking with their families and friends ... some knowledge of just how hard this is has percolated down," said Marlowe, who has traveled to Afghanistan many times.

It has also been hard to show progress on the battlefield.

World War II had its Normandy, Vietnam its Tet Offensive and Iraq its Battle of Fallujah. Afghanistan is a grinding slough in villages and remote valleys where success is measured in increments.

The Afghan war transformed into a series of small, often vicious and intense fights scattered across a country almost as large as Texas.

What's leading Afghan troops to turn on coalition forces?

In July, 40 U.S. service members died in Afghanistan in the deadliest month for American troops so far this year. At least 31 have been killed this month ? seven when a helicopter crashed during a firefight with insurgents in what was one of the deadliest air disasters of the war. Ten others were gunned down in attacks from members of the Afghan security forces ? either disgruntled turncoats or Taliban infiltrators.

Many argue that bin Laden's death justifies a quick U.S. exit from Afghanistan. Others say it's important to stay longer to shore up the Afghan security forces and help build the government so that it can stand on its own. An unstable Afghanistan could again offer sanctuary to militants like al-Qaida who want to harm American and its allies, they say.

"Those of us who have been at this for a long time continue to think that it's important, and that we have a chance now of a path forward with a long-term perspective that will produce the results," said James Cunningham, the new U.S. ambassador to Afghanistan.

US forces in Afghanistan ordered to keep weapons loaded at all times

The U.S.-led coalition's combat mission will wind down in the next few years, leading up to the end of 2014 when most international troops will have left or moved into support roles.

Military analysts say the U.S. envisions a post-2014 force of perhaps 20,000 to hunt terrorists, train the Afghan forces and keep an eye on neighboring Iran and other regional powerhouse nations.

Americans aren't likely to know the number until later this year. But will anyone other than families of service personnel take note?

As NBC's Jim Miklaszewski reports, US military officials are investigating whether or not the Taliban was in fact involved in deadly Black Hawk helicopter crash that claimed the lives of seven US soldiers and four Afghan troops.

"I have heard others say that the danger that their spouses or children are serving in is just simply not being cared about," said Fred Wellman, a 22-year Army veteran who did three tours in Iraq. "I think a lot of veterans feel it is just forgotten."

Political satirist Garry Trudeau captured the apathy about the war in a comic strip this year showing a U.S. servicewoman stationed in Afghanistan calling her brother back home.

After he complains that his children have the flu and how he's struggling to keep up with their hectic hockey schedule, he asks her where she's calling from. She tells him she's in Afghanistan.

"Oh, right, right ..." her brother replies. "Wait, we're still there?"

Norway faces hard decisions as Breivik verdict nears

OSLO (Reuters) - As the trial of Anders Behring Breivik comes to an end, Norway is just starting to shape its future as a nation no longer isolated by its great wealth from a troubled outside world.

Survivors of Breivik's massacre are waiting for Friday when an Oslo court passes judgment on the anti-Muslim gunman, hoping to return to something like the lives they led before he slaughtered 77 people last year.

Norwegian society, however, must still balance its liberal and conservative traditions exposed by Breivik's 10-week trial as it decides how to deal with security and intelligence surveillance, gun controls and rising immigration.

"We are no longer so naive to believe that Norway is the best country in the world," said Mette Yvonne Larsen, one of the three lawyers in court representing victims of Breivik's attack on July 22, 2011. "It has made us understand we are a part of international society. We cannot solve problems by ourselves."

For survivors such as Khamshajiny Gunaratnam, the most pressing need is to hear the verdict after a trial that went into every detail of Breivik's bomb attack in Oslo that killed eight, and his shooting dead on Utoeya island of 69 people, mostly teenagers.

"After Aug 24, we can be done with it," Gunaratnam told Reuters.

With what witnesses described as a "joyous battle cry", Breivik arrived at the island youth camp of the ruling Labour Party dressed as a policeman. He regarded his victims, the youngest of whom was 14, as brainwashed "cultural Marxists" whose support for Muslim immigration threatened Norwegian ethnic purity.

Gunaratnam, aged 24, escaped the massacre by jumping into icy lake waters and swimming for her life. She survived because Breivik was busy shooting her friends in the head at point blank range, presuming she would drown.

SANE OR INSANE?

The verdict itself is not about Breivik's guilt but whether, as prosecutors say, he is insane.

If Breivik is declared sane, his maximum sentence is 21 years, although this can be extended if he is seen as a danger to society. If declared insane, he faces indefinite mental care under lock and key.

The 33-year-old well-to-do son of a former diplomat is jailed in a three-room cell. He has a computer in one room, a treadmill to keep fit in another, access to TV and newspapers and is allowed a daily stroll in the fresh air outside.

Whatever the verdict, Breivik will probably spend the rest of his life in similar conditions, underscoring what some Norwegians regard as an excessive civility in the face of the cold-blooded killings.

Lawyers for the survivors say some do not care about the verdict while others would prefer Breivik be declared sane, meaning he takes responsibility for his actions.

Breivik himself wants to be ruled sane and his attack considered a political statement rather than an act of lunacy. He has said an insanity verdict would be "a fate worse than death" and that he would appeal it, prolonging the survivors' ordeal.

A COUNTRY APART

Beyond the survivors' personal feelings, the country of five million people faces difficult decisions following its worst massacre since World War Two.

Norway's huge oil wealth has long set it apart from other nations. It has prospered outside the European Union, and its economy is expected to grow more than three percent this year while many European neighbors are stuck in recession.

Likewise, its strong political and legal systems mean it has avoided the corruption that afflicts many other oil producers.

With more than $600 billion in reserves from its oil fund, pristine forests and a welfare system that is the envy of the world, Norway has often looked haughtily at the rest of Europe.

However, some Norwegians now believe their country must draw on the experience of other nations to debate issues such as immigration as the oil wealth attracts large numbers of foreign workers.

These are being discussed more openly after the killings by Breivik, who believed the government's immigration policies were adulterating Norwegian blood and leading to war with Muslims.

"We know now that Norway can be a source of terrorism ... it has led us to just start talking about what kind of society we want," said Geir Lippestad, Breivik's lawyer. "What to do about right-wing fundamentalists, access to internet sites by extreme groups. We have just started the discussion."

"Norway is more aware of racism now, of the issues of multiculturalism. Hopefully, we can start a process that Norway can open up more for the rest of the world," he told Reuters.

NORWAY TRIES TO STAY THE SAME

On the face of it little has changed since the killings. The foreign ministry has new road blocks on its nearby street and a security check has been set up at the prime minister's office. But government ministers still walk around without bodyguards and you can drive right up to the parliament building.

After the massacre, Prime Minister Jens Stoltenberg stressed that Norway would make no gut reactions that would infringe on its tradition of open democracy.

When prosecution lawyers shook hands with Breivik at the start of the trial, this civility sent a deliberate message that he would not force changes on the Norwegian way of life.

In some ways they succeeded. Opinion polls show more Norwegians accept multiculturalism - policies designed to accommodate differing communities - as the immigrants flock in.

Norway's population grew 1.3 percent last year, one of the fastest rates in Europe, and net immigration accounted for 71 percent of that growth. While immigrants arrived from all round the world, 70 percent of them came from Europe.

"People are more aware of the danger of anti-Muslim rhetoric. We are more aware that some ideas can become very dangerous," said Larsen.

But Norwegians' civility is being tested already. A 500-page official report last week into the attacks found a host of mishaps and mistakes by police and intelligence services allowed Breivik to carry on the attacks unimpeded.

Norway's police chief resigned after the report and the intelligence service are pressing for more surveillance powers.

Stoltenberg, who drew widespead praise for his measured and dignified leadership after the attack, is now under pressure to resign following the report. The conservative opposition has gone on the offensive before parliamentary elections next year.

The report also touched on a subject at the heart of Norway - wide gun ownership in a country where hunting is a national pastime, a legacy of Cold War defense preparations and Norway's strong rural culture.

But the commission's proposal to ban semi-automatic weapons - the kind that Breivik bought easily - may founder on opposition from many of Norway's conservative voters for whom gun ownership, like in the United States, is a right.

Some critics of the government say Norway is also unprepared for its role in the outside world, saying its presence in the NATO-led force in Afghanistan, for example, could make it a target for further attacks.

All these debates need to be settled after the Breivik verdict. "Perhaps it was necessary to have a year of mourning," Brent Aadal, political scientist at the Institute for Social Research. "Now we have to move forward and respond to real challenges."

Mexico, Calif. move on at LLWS; Uganda scores win

SOUTH WILLIAMSPORT, Pa. (AP) ? Powerful Petaluma, Calif., can pitch, too.

Hance Smith's three-run homer in the third broke open a tight game, and reliever-turned-starter Quinton Gago struck out seven over 5 1-3 innings in a 5-0 win Tuesday night over Fairfield, Conn., in the Little League World Series.

California moves on to the U.S. semifinals on Thursday night. Connecticut was eliminated.

The 12-year-old Gago said it was the best performance of his young career, even though he was a little nervous when the night started.

"In the back of my mind, I said 'I am not a starter,'" Gago said as he held on to an ice pack strapped to his left shoulder. "But right as I took the mound, I felt it went away."

Nuevo Laredo, Mexico also is moving on after a 6-2 victory over Willemstad, Curacao, and Lugazi, Uganda made the biggest splash Tuesday with a win in its tournament finale.

The first team from Africa to qualify for youth baseball's biggest tournament notched another first with a 3-2 victory over Gresham, Ore. in a consolation game. Uganda dropped its first two games in the series.

In the nightcap, Gago stifled Connecticut.

Fairfield's best chance came in the second when Michael Ghiorzi led off with a single, and an error made it runners on first and second with nobody out.

But third baseman Cole Tomei charged a bunt and started a 5-6-4 double play, and Gago got a strikeout to end the threat.

"That was completely awesome," Gago said about the double play. "That double play really helped me out a lot. I really liked that."

Ryan Meury led off the Connecticut sixth with a double, and Gago left after a groundout because he had reached his pitch limit. He got a hug from a teammate before heading to the dugout.

Reliever Andrew White closed it out, and the teams exchanged handshakes at the plate before the California kids returned calmly to their dugout while a marching band played in the stands.

After his team won elimination games in three consecutive days, manager Eric Smith said he planned to give his boys Wednesday off. But White quickly reminded him of one trip he promised they could make.

"What about Dairy Queen?" the 12-year-old White asked.

"You guys are like brothers. The (coaches) love you guys, and we've had a great three years together," Meury said in recounting the meeting. "You should walk off this field with your head held high because you gave Fairfield one of the best summers they've had in a little while."

Earlier Tuesday, 11-year-old Ronald Olaa put Uganda in front when scored from second on a throwing error in the bottom of the fifth.

Manager Henry Odong said he urged his team to just make contact because hitting had been a challenge in South Williamsport.

Uganda plans to play more exhibition games this week, but the players already have become Little League stars. They are being hounded by young autograph-seekers, and Odong was stopped several times by fans for pictures while going to his seat in the stands to watch California's victory.

"I'm thankful we could come here," Odong said. "This win was so great."

Mexico also was feeling pretty good after clinching a spot in Thursday night's international semifinals. Ramon Ballina hit a three-run drive for his third homer of the tournament.

The World Series success is hardly a surprise for the 13-year-old pitcher.

"I hit the ball better in our national tournament, actually," Ballina said through an interpreter.

Mexico played without manager Fernando Rios, who was suspended for two games after a player on his roster did not bat during a 4-3 victory over Taiwan on Monday night.

Coach Cesar Mata took over for Rios.

"I was worried when I get up this morning," Mata said. "We got the kids together and had a long talk in the dorms. They listened and they were very relaxed. I didn't worry about it after that."

Oil lifted by supply, geopolitical worries

NEW YORK (Reuters) - Oil prices rose on Monday in choppy trade, hitting a three-month peak on concerns about North Sea supply and Middle East tensions, while fears about a slowing global economy checked gains.

U.S. crude briefly turned lower and Wall Street equities fell, weighed down by data showing Japan's economy expanded in the second quarter at half the pace expected.

A separate report showing Greece's economy contracted by 6.2 percent on an annual basis in the quarter also fanned concerns about economic growth.

Brent jumped more than $2 and U.S. crude more than $1 early in the session on support from tightening North Sea supplies and Middle East tensions, including an intensifying debate in Israel on whether to strike Iran's disputed nuclear program.

A weak dollar also helped crude futures' early surge, along with continuing hopes that signs of economic weakness will spur central banks to stimulate a sputtering global economy.

The expected North Sea production drop to record lows in September and the sensitivity to Middle East supply disruptions helped send Brent's premium over U.S. crude to more than $21 a barrel.

Those factors also sent front-month Brent's price premium to the nearby month above $2 a barrel intraday, a 2012 high, ahead of front-month September's contract expiration on Thursday.

Brent September crude rose $1.62 to $114.57 a barrel by 1 p.m. EDT (1700 GMT), having reached $115.11, the highest intraday front-month price since May 4.

"The likelihood of some sort of intervention to stimulate economies is supporting the market," said Christopher Bellew, an oil broker at Jefferies Bache in London. "Also the North Sea, Iran and the Middle East are still a factor."

U.S. September crude was up 46 cents at $93.33 a barrel, seesawing either side of the $92.91 100-day moving average after reaching $94.14.

Trading volumes remained thin, well below 30-day averages. This helped cause the seesaw price trajectory, according to traders and analysts.

"Weak economic data from Japan is a concern as Japan is a big consumer of oil," said Phil Flynn, analyst at Price Futures Group in Chicago.

"On the upside, oil futures have been supported by geopolitical concerns in the Middle East," Flynn said.

NORTH SEA OUTPUT DROP

Brent crude especially is being supported by expectations of shrinking North Sea production, elevating the price of the front-month contract versus the nearby contract and contracts for later delivery, a structure known as backwardation.

North Sea crude oil output will fall by about 17 percent in September from August, mainly due to a drop in Forties crude production with the Buzzard oilfield offline for maintenance.

IRAN AND MIDDLE EAST

The North Sea output drop comes with the European Union's embargo on Iranian oil in its second month as the West's dispute with Iran over Tehran's nuclear activities drags on.

Remarks by Prime Minister Benjamin Netanyahu on Sunday, stating that most threats to Israel's security were "dwarfed" by the prospect that Iran could develop nuclear weapons, kept fears about potential threats to the region's oil supplies in focus.

Russia sharply criticized new U.S. sanctions against Iran on Monday, saying the measures to punish banks, insurance companies and shippers that help Iran sell its oil would harm Moscow's ties with Washington if Russian companies were affected.
