'Stand Your Ground' law muddies Martin case

The Department of Justice has launched an investigation into the death of the teen shot in the picturesque city of Sanford, Fla. NBC's Ron Allen reports.

Florida?s 2005 ?Stand Your Ground? law, which says a citizen doesn?t have to retreat before using deadly force against an attacker, could throw a legal wrinkle into the case of a neighborhood watch captain who shot to death an unarmed black teenager.

Police in the central Florida town of Sanford have said that 28-year-old George Zimmerman says?he shot 17-year-old Trayvon Martin in self-defense during a confrontation in a gated community. Police have described Zimmerman as white; his family says he is Hispanic and not racist.

Police did not arrest Zimmerman after the shooting, but State Attorney Norm Wolfinger announced Tuesday the case will go before a Seminole County grand jury.

Legal experts, gun-rights advocates and gun-control groups contacted by msnbc.com offered varying opinions on whether Zimmerman can avoid criminal charges under Stand Your Ground.

Richard Hornsby, an Orlando-based criminal defense attorney, says he thinks the grand jury is likely to indict Zimmerman for manslaughter, a second-degree felony punishable by up to 15 years in prison. Less likely is a more serious charge of second-degree murder, a crime that implies intent and that is punishable by up to life in prison, he said.

?This case isn?t even a close call to me. This is a case of a guy trying to be a vigilante,? Hornsby said. ?It wasn?t like he was trying to avoid trouble. He brought a firearm to a fistfight.?

?My gut feeling he will ultimately be charged with some type of manslaughter charge,? agreed Philip Sweeting, retired deputy police chief for the Boca Raton Police Department and a law enforcement consultant who has testified? in court cases as an expert in police shootings and use of force.

?My gut reaction was this was an accidental discharge,? Sweeting added. ?If you put yourself in the shooter?s position and you?re wrestling with this kid and a gun goes off, what are you going to tell the cops??

If indicted, Zimmerman can raise the Stand Your Ground defense under?the 2005 law signed by Gov. Jeb Bush. That legislation, derisively called the ?Shoot First? law by its critics, gives Floridians the right to use deadly force to defend themselves in public places without first trying to escape. The National Rifle Association lobbied hard for the bill, saying it would allow citizens to better protect themselves from violent crime.

The key section of the law states:

A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony."

Kendall Coffey talks about the legal developments in the Trayvon Martin case and Florida's "Stand Your Ground" law.

Hornsby says the 2005 bill allows Zimmerman?s lawyers to argue to a judge ? before any trial -- that the case should be dismissed on grounds he was permitted to defend himself. If the case isn?t dismissed,?they could argue self-defense at trial.

Daniel Vice, senior attorney with the gun-control group Brady Center to Prevent Gun Violence,?contends ?Stand Your Ground,? combined with Florida laws allowing people to carry guns in public, have made it difficult to pursue criminal charges against people who shoot others and then say?it was self-defense.

?All you have to say is that you reasonably believed you were threatened, and the only person who can dispute that is the person you have just killed,? Vice says.

"It's very hard to bring these types of cases because the 'Shoot First' law combined with public carrying of loaded guns protects people who engage someone and shoot to kill."

According to a 2010 review by the St. Petersburg Times, reports of justifiable homicide tripled after the law went into effect. It has been invoked in at least 93 cases with 65 deaths, used to excuse violence in deadly neighbor arguments, bar fights, road rage and even a gang shootout, the newspaper reported.

Gun-rights advocates say the facts to date are scarce and ?Stand Your Ground??may or may not apply?in this case.

According to transcripts of the 911 calls, a police dispatcher tells Zimmerman he doesn?t need to follow the teen, but Zimmerman apparently does anyway. So is he or the teen the one who feels threatened?

?The question again is whether he (Zimmerman) acted reasonably or not. At this point it doesn?t look good for him, but I don?t know what the heck happened and quite frankly no one else does either,? says Jon H. Gutmacher, an Orlando attorney, NRA-certified instructor and author of "Florida Firearms: Law, Use & Ownership."

?When you?re talking about law and whether things were legal and illegal, you can?t guess. You?re supposed to react to facts. The facts have been kept from the public and the press.?

Added Dave Workman, director of communications for the Citizens Committee for the Right to Keep and Bear Arms: ?There?s a misunderstanding about what Stand Your Ground laws really do. No Stand Your Ground law translates to a broad permission for the use of lethal force when it?s not warranted.?

He added: ?A lot of people have left the starting gate before they really know what has happened. A rush to judgment is never a good thing.?

Kids may easily become confused, upset or scared if a family member with Alzheimer?s forgets their name, says something inappropriate or becomes angry and violent for no reason. Unpredictable or bizarre behaviors may cause children and teens to avoid spending time with their grandparents, causing both parties to miss out on an important relationship.

Here are some helpful phrases to use in explaining Alzheimer?s disease to your kids and teens:

  • ?Grandma has a disease called Alzheimer?s. It causes her to forget things and act differently then she used to. But Grandma is still there inside, underneath the disease.?
  • ?You can?t catch Alzheimer?s disease from being around Grandpa. His brain just doesn?t work as well as it used to.?

Freed after 20 years of injustice, he hits the books

Franky Carrillo walks the campus of Loyola Marymount University. His backpack is filled with books. His days are now filled with freedom.

Carrillo spent 20 years behind bars for a murder he did not commit.

While incarcerated, Carrillo earned his GED, but says he always dreamed of going to college. Now he is a 37-year-old, part-time freshman at LMU, and Friday marks the one-year anniversary of his newfound freedom.


He says he feels embraced by the staff and students: "The community of LMU has been great. It's become a sanctuary for me. It has this element of a wonderland."

But it has been a long and difficult road to this "wonderland."

In 1991, Carrillo was 16 years old and living in Maywood with his father. He ran with a bad crowd, but had never been in any trouble.

"I definitely wasn't an angel but I definitely was not a murderer," he said.

It was early morning, Jan. 24, 1991, when Carrillo says 15 sheriff's deputies with guns drawn stormed through the front door.

"My dad said in Spanish and I said it in English: 'What's going on? Why?' And no one would say anything until eventually someone said, 'You know why.' And that's all they gave us," Carrillo said.

Carrillo says a "gang" of corrupt and racist Los Angeles County Sheriff's deputies -- known as the "Lynwood Vikings" -- coerced and threatened key witnesses into identifying him in a photo lineup.

Carrillo was convicted of murder and sentenced to two consecutive life terms.

When Carrillo talks about his time in prison, he uses words like "dehumanizing," "demoralizing" and "isolating." He served his last 10 years at Folsom State Prison, where he says he feared for his safety.

"I was very afraid, but I think being afraid was one of the elements that kind of kept me alive because it put me very, very aware of my surroundings," he said.

Carrillo says he did not know the victim of the murder, and that he was at home watching TV when the drive-by shooting happened. He knew a mistake had been committed; the system had gone astray and sent the "wrong guy" to prison.

Carrillo wanted to prove his innocence. He began a letter-writing campaign, begging lawyers and media outlets to listen to him.

Finally, someone heard him.

Carrillo calls Ellen Eggers an "angel" who "lives justice; it just radiates from her."

Eggers, an attorney, says she was convinced of Carrillo's innocence after meeting him just once, and not just because his earnestness and manners, but more importantly because Carrillo had evidence from the real shooter.

Eggers says he showed her "a six-page, scrawled-out, in-pencil, handwritten series of notes that basically is a confession to the drive-by murder that Frankie was convicted of."

Eggers works as a public defender in Northern California, specializing in death-penalty cases. Because Carrillo was a minor when he was convicted, he was sentenced to consecutive life terms, not the death penalty, and therefore did not fall under Eggers' prevue.

But the more she learned of Carrillo's circumstance, the more Eggers was determined to get him freed.

Eggers took the case pro-bono. She gave up weekends, summers and vacations to prove Carrillo's innocence. She says it was a consuming project.

"The experience of spending that much time with Frankie just bonded me with him so completely. I literally felt that I was locked up with him," she said.

One of Eggers' biggest challenges was that Carrillo's conviction hinged on eyewitnesses.

"There was no DNA in Franky's case. There wasn't even a gun. I mean, it was all just eye-witness testimony," Eggers said.

Eggers was advised that in order for Carrillo to have any chance of getting his conviction overturned, all of the witnesses would have to recant their testimony.

This was a daunting task.

She says the detailed hand-written notes that Carrillo had shown her were critical in getting the witnesses to realize that "a mistake had been made."

Ultimately every witness recanted their testimony.

During one moving and surreal moment in court, a key witness apologized to Carrillo, and Carrillo forgave him, said Eggers.

When witnesses change their original testimony, it is often met with skepticism -- which is why Eggers implored the judge see the exact spot where the teens claimed to be able to see Carrillo as the shooter.

"It is absolutely essential that you see for yourself, so you don't have to know whether the witnesses told the truth back then or they are telling the truth now. You need to see with your own eyes," Eggers told the judge.

The legal teams and the judge visited the crime scene on a night when the moon was similar to the night of the crime. Then they reenacted the drive-by shooting.

This field trip proved invaluable.

Eggers says it proved to the judge that there was "no way, physically possible that anyone standing on the curb could have identified anyone inside that car that was driving by."

On March 14, 2011, the District Attorney's office conceded the case and two days later, Carrillo walked out of prison.

His conviction was overturned. He was free.

Although part-time now, Carrillo has been accepted as a full-time LMU student for the fall of 2012.

LMU President David Burcham says when he first met Carrillo, he was impressed with his "dignity" and that the school felt an "obligation to assist."

"As you know, when a prosecution is brought against an individual in this state, it's brought on behalf of the people of the state of California. We thought that when a mistake is made, that the people of California have an obligation to try to help," Burcham said.

Carrillo is now busy building a full and meaningful future for himself. In addition to being a student, he is politically active and lobbies against the death penalty. He lectures on campus and at juvenile halls about his experiences. He volunteers at an orphanage in Tijuana.

His work at the orphanage clearly moves him. He refers to it as "a jail of little kids that had been forgotten about."

Carrillo tears up when he talks about the connection he feels when he holds a small child.

"It takes me back to a time in prison, where I myself was deprived from human emotion -- being deprived from just being human," Carrillo said.

Despite experiences that few people can imagine, Carrillo says he believes in justice and forgiveness, and hopes to help others in any way he can.

While he was in prison, Carrillo missed out on a lot. His son was born. His father died. He says it hurts him to think that his father did not live to see him free.

Carrillo lost 20 years -- good years, the years when most people go to college and find love and build careers.

He says although many people would understand if he were angry and bitter, he just can't be.

"I'm not bitter. It defeats the purpose of wanting to be free. I could not imagine my life now as a free man having a frown on my face."

Google+ photos now more easy to rearrange

"Rearranging photos and moving them between albums are two of our top feature requests. Today, we?re excited to launch an album organizer so you can better tell the story of your photos," he wrote.

Here are his instructions to get started:

Open one of your albums and select Organize album from the Options menu. With the album organizer you can:

Sort photos by time: Click Order by date to sort all photos in the album by the photo date, from earliest to latest. Click it again to sort them from latest to earliest.

Reorder your photos: Select the photos you want to reorder and drag them to their new position in the album. You can also move selected photos to the start or end of the album by clicking Move to top or Move to bottom.

Move or copy photos to another album: Clicking Move lets you move or copy selected photos to one of your other albums or to a new album.

Delete a bunch of photos: Click Delete to delete the selected photos.

Nuclear Woes Push Japan Into A New Energy Future

The tsunami that struck Japan last year destroyed four nuclear reactors at the Fukushima Dai-ichi nuclear power station on the east coast of the country. Radiation spread through the air and into the ocean, and workers labored for weeks to quench the melting reactor cores. Farmland and numerous towns were evacuated and much remains off-limits.

Since then, Japan has been temporarily shutting down its remaining nuclear plants as the public debates whether to swear off nuclear power permanently. But saying no to nuclear has been and will continue to be costly.

Before the accident in Fukushima, Japan got a third of its electricity from nuclear reactors. That made economic sense ? Japan has almost no coal, oil or natural gas to make electricity.

Nuclear Or No Nuclear?

Japan faces a choice ? it can either restart its fleet of 54 nuclear power reactors or keep them offline. If the reactors stay offline, the country will need to meet energy demands by increasing the consumption of fossil fuels.

Economist Mitsutsune Yamaguchi at the University of Tokyo says those nuclear power plants are now idle. "Out of 54 existing plants, only two are in operation, and by the end of April it will become zero," Yamaguchi explained in an interview in Washington, D.C. Yamaguchi has been on several government panels studying what to do about the country's energy dilemma.

Several nuclear plants are still damaged from the quake and the rest have been idled as Japan sorts out what kind of energy it wants in the future.

Yamaguchi says restarting nuclear plants is no longer just up to the central government. It's up to the public. "Even if government says, 'Yes, you can do it,'" he explains, "unless local mayors, governors or local residents say 'Yes,' power companies cannot start" the idled reactors.

Meanwhile, the economy is taking a nosedive. For the first time in decades, Japan's vaunted trade surplus is gone. The country now spends more on imports than it earns from exports. What is Japan buying? Fuel.

"The major utilities in Japan have increased their consumption of fuel oil by more than double," says Jesse Jenkins, an energy analyst at the Breakthrough Institute, a research group. The institute is in favor of nuclear power as a hedge against climate warming. Japan, says Jenkins, "has increased their use of liquefied natural gas by about 27 percent and relied more heavily on coal as a share of their energy use."

And that's expensive. One analysis by the International Energy Agency in Paris says replacing the electricity from idled nuclear plants is costing Japan an extra $100 million a day.

Carbon Emissions On The Rise

Then there are the climate effects. The nuclear reactors were not emitting carbon dioxide, the main greenhouse gas that contributes to global warming. Oil, coal and natural gas do.

Jenkins says Japan's goal to reduce carbon dioxide emissions is now shelved. In fact, emissions are going up. "They're swapping fossil fuels for nuclear and that's driving up their CO2 emissions and the carbon intensity of their electricity supply," he says.

Most of the new fuel is liquefied natural gas. It's cleaner than coal or oil. but Laszlo Varro, with the International Energy Agency, says the amount needed if Japan doesn't return to nuclear power is staggering. "You would need almost 20 percent of the entire global market of liquefied natural gas," he calculates.

Varro notes that a lot of that natural gas comes from the Middle East through the Straits of Hormuz, a shipping route threatened by tensions over Iran's nuclear ambitions.

The Japanese government and green groups aren't happy about relying on fossil fuels, and there's strong sentiment to adopt a new energy mix that relies mostly on wind and solar power. That will take decades, though. Renewable energy in Japan now provides about 2 percent of the nation's electricity; nuclear provided 30 percent.

In the meantime, as the economy recovers from the tsunami and earthquake, industry will need more electricity. The Japanese public will be asked to sacrifice, as they have over the past year. Yamaguchi says it's a daunting future. "It's a mess, you know," he laments. "We have to cut our consumption itself. We did it. But whether we can continue for the coming five, six, seven years without sacrificing the Japanese economy, it's almost impossible."

But Japan has been through tougher times. Its engineers are second to none and the country is wealthy. The IEA's Varro says a wholesale shift to green energy isn't impossible. "It is certainly going to be expensive," he predicts. "How slow it is, that depends on the decisions that Japan makes. Japan is a rich and technologically sophisticated society. I think they have the potential to surprise us."

After the nuclear accident last year, a Japanese word became popular in conversation: "setsuden." It means "energy-saving." Perhaps the next phrase to catch on will be: "necessity is the mother of invention."

Greece averts immediate default with bond deal

Greece averted the immediate risk of an uncontrolled default on Friday, winning strong acceptance from its private creditors for a bond swap deal which will eat into its mountainous public debt and clear the way for a new international bailout.

Finance Minister Evangelos Venizelos hailed the deal, which the nation's international lenders had demanded in return for the 130 billion euro ($172 billion) bailout, as marking a long-awaited success for all Greeks enduring a long recession.

The European Union said the swap, under which private creditors have accepted heavy losses on their Greek bond holdings, would make a "decisive contribution to financial stability in the euro area as a whole".

But markets sharply marked down the value of new Greek bonds to be issued to the creditors, reflecting the risk of paralysis after elections expected this spring and doubts about whether Athens can bring its debt to a more manageable level by 2020.

"Today, after a very long time, is a very good day (for the country) as well as for me personally," Venizelos told lawmakers, saying the deal had cut Greece's debt burden by 105 billion euros.

"I hope everyone will realize, sooner or later, that this is the only way to keep the country on its feet and give it the second historic chance that it needs," said Venizelos, who negotiated Greece's second bailout since 2010 with the European Union and International Monetary in often ill-tempered talks.

Under the biggest sovereign debt restructuring in history, Greece's private creditors will swap their old bonds for new ones with a much lower face value, lower interest rates and longer maturities. This means they will lose about 74 percent on the value of their investments, slicing more than 100 billion euros off Greece's crippling public debt.

The finance ministry said creditors had tendered 85.8 percent of the 177 billion euros in bonds regulated by Greek law. This would reach 95.7 percent of all privately-held Greek debt with the use of "collective action clauses" to enforce the deal on creditors who refused to take part voluntarily.

European Economic and Monetary Affairs Commissioner Olli Rehn, a leading figure in efforts to protect far bigger economies with debt problems such as Italy and Spain, said he was very satisfied with the private creditors' response.

"That contribution by the private sector is an indispensable element to ensure future sustainability of the Greek public debt and, thus, a decisive contribution to financial stability in the euro area as a whole," Rehn said in a statement.

But he told Athens, which has a record of failing to meet its austerity promises, to stick to the bailout's terms.

"I now expect the Greek authorities to maintain their strong commitment to the economic adjustment program and to rigorously and timely implement the policy package," he said. "The success of this program is a cornerstone of our comprehensive response to the current crisis."

Euro zone finance ministers are expected to release the bailout funds next week. Athens must have the money in place by March 20 when some 14.5 billion euros of bond repayments are due, which it cannot hope to repay alone.

Daunting problems
Greece remains a long way from solving its daunting economic, political and social problems. Reforms demanded by the EU and IMF along with deep budget cuts have provoked serious violence in Athens and helped propel unemployment well over 20 percent as the nation suffers its fifth year of recession.

The country also faces elections in April or May when the pro-bailout conservatives and socialists face an array of smaller parties to the left and right that reject the rescue, and may struggle to form an effective government.

Traders priced in the profound doubts surrounding an overall program which aims to cut Greece's debt from a towering 160 percent of its annual economic output now to a slightly more manageable 120 percent by 2020.

On the grey market, they indicated prices far below the face value of new bonds which will be issued to creditors on Monday.

Spanish and Italian bond yields fell following the Greek announcement. However, those on debt issued by Portugal, which has also been bailed out by the EU and IMF, rose as investors looked for the euro zone's next weakest link.

The deadline for acceptance of the offer for bonds governed by international law and for state-guaranteed bonds issued by public companies has been extended to March 23.

Athens confirmed it would enforce the deal, activating collective action clauses (CACs) on the bonds regulated under Greek law. It will not be so easy to force holders of bonds governed by foreign laws to come to the table.

Using the CACs is likely to trigger payouts on the credit default swap (CDS) insurance that some investors hold on the bonds. The International Swaps and Derivatives Association said it will meet on Friday at 1300 GMT to decide whether Greek credit default swaps will pay out.

"It almost now certainly going to trigger CDS. If this doesn't trigger it, nothing will," said Nick Stamenkovic, a bond strategist at RIA Capital markets in Edinburgh.

Venizelos played down the consequences. "This is not a concern for us because the net amount at stake globally if CDS are triggered is less than 5 billion (euros)," he told parliament. "This is a totally negligible sum for the Greek and the European economy."

Optimism
Despite the success, the deal will not solve Greece's deep-seated problems and at best it may buy time for a country facing its biggest economic crisis since World War Two and crushed under debt equal to 160 percent of its gross domestic product.

Markets showed investors have no faith that the bond swap will draw a line under the country's troubles. Under Greece's austerity and reform program, its debt burden in 2020 should be proportionately similar to that at the moment of Portugal.

This means yields on Greek and Portuguese bonds should be similar, provided investors believe Athens will meet its debt target. This was not the case on the grey market, with yields at 17-21 percent, far above Portuguese levels around 11-14 percent.

"The market is pricing a high risk premium which reflects uncertainty over upcoming elections in Greece and reform implementation risk," said on Athens dealer.

Greece has staggered from deadline to deadline since its crisis broke two years ago and several of its international partners have expressed open doubts about whether its second major bailout in two years will be the last.

"The upcoming election in Greece next month will be the next risk factor," said Yuji Saito, director of the foreign exchange division at Credit Agricole Bank in Tokyo.

Public support for the two parties that back the bailout - those in the coalition of technocrat Prime Minister Lucas Papademos - remains low.

"After the elections, no matter when these will take place, we (must) have a government of authority, determined to walk the difficult path of reforms. Otherwise, all sacrifices that were made will be wasted," said the Athens financial daily Imerisia.

Resentment has grown among ordinary Greeks over the austerity medicine ordered by international creditors which has compounded the pain from a slump which has seen the economy shrink by a fifth since 2008.

Underlining the severe problems facing Greece after five years of deep recession, data on Thursday showed unemployment running at a record 21 percent in December, twice the euro zone average, with 51 percent of young people without a job.
