Ruth Starkman: Privacy, Human Rights at Legal Frontiers of Digital Media

New markets, copyright, IP addresses, freedom of speech, human rights and, of course, privacy -- these were the hot topics of the Legal Frontiers of Digital Media Conference, which was jointly sponsored by the Media Law Resource Center and Stanford University's Center for Internet & Society. The two-day event provided a crash course in emerging legal issues surrounding the distribution of content on digital platforms.

Remarking on the impressive turnout and lively discussions, organizer Sandra S. Baron, executive director of the New York-based Media Law Resource Center, elaborated on the conference goals of shedding light on "the legal side on the intricacies of the technologies" and educating participants about "some of the key legal traps" and "some of the ways to manage them."

Beyond the legal community, the conference drew a wide audience from international policy groups, publishers, media corporations to small start-up entrepreneurs and journalists to academics and students, undergrads and grads in digital media, all of whom came to hear the perspectives of digital media and law experts from AOL, Inc., Dow Jones & Company, Electronic Frontier Foundation, Evernote Corp., Facebook, Google, LinkedIn, Microsoft Corp, Pandora, San Jose Mercury News, Warner Brothers, Yahoo, and venture capitalists such as August Capital, Blumberg Capital, CMEA Capital.

The Monday sessions commented on the future of journalism, the problem of monetization, copyright, the DMCA (Digital Millennium Copyright Act) and complex questions about which human rights principles and laws US-based internet companies should apply when operating overseas in environments.

Many audience members were Internet veterans, who have spent years confronting legal issues with content distribution on digital platforms. Fred von Lohmann, senior copyright counsel at Google, reflected on how copyright has been an issue since the earliest search engines. Asked how to address the various obstacles of digital platforms, he cheerfully sloganeered "As we say at Google 'launch and iterate,' " by which he meant the best approach for digital media companies, since the waters of copyright will remain murky for some time, is simply to launch content, learn from the inevitable public and legal response and then improve. The "launch and iterate" mentality allows for experiments in freedom of expression as well as public participation.

The conference theme of "frontiers" articulated a keen urgency to protect the diverse and far-flung reading and writing publics, who use digital media. Thus, much of the discussion centered on the limits of involvement in countries that restrict freedom of expression and the potential impact on human rights in those countries. Addressing the increasingly global operation of Internet platforms, panelists asked how to prevent the industry from sinking to the "lowest common denominator" of free speech as defined by regimes in authoritarian countries.

Ebele Okobi of Yahoo! offered the example of Yahoo!'s decision to abide by Singapore's laws even for their operations in their Vietnam site, and also raised questions about employee safety in countries less open to free speech.

Such questions also impact North American and European contexts, where U.S. and European norms differ greatly and the average user may understand neither free speech nor defamation and how to better educate the public on what is permissible and legal in a world of often notorious "over-sharing" in social media.

The second day began with Internet privacy issues. Nick Doty of University of California, Berkeley and the World Wide Web Consortium (W3C) helped explain the operational side of social media and how privacy works in such companies as Facebook, Twitter, Flickr and Pinterest. A chill set over the room as Doty reminded the audience of experienced digital media users of what they should already understand:

"You know that your smartphone has GPS and maybe you also know that it embeds your photos with your current location. Well, anyone who later receives those files, through social media or some other means would then have access to information about where you were at the time...." The implications were clear that such access to information could lead to serious harm if not sufficiently protected.

Indeed (even self-induced) over-exposure from social media has consumers worried -- as many still continue to participate in a culture of incessant sharing. The conference hoped to address these consumer concerns, especially as users become better educated about social media and ask more questions about their privacy.

Most striking in these sessions was the impression that all social media companies assert their interest in privacy and their anxiety about consumer and press responses.

"Privacy more than ever is a brand issue" insisted Jay Mohanan, Deputy General Counsel at Zynga Game Network Inc. Surely, it's in the interest companies to secure privacy and it's good business to let consumers know about such efforts. Industry has a lot to lose if it fails to secure privacy for consumers.

Consumer privacy keeps social media companies awake at night:

Many commented that the lack of privacy could stifle further innovation. Nick Doty, for example: "If we don't figure out privacy issues, we'll miss out on the next awesome social media service."

Facebook's legal counsel Susan Cooper related her company's efforts to institute "privacy by design," that is, to build privacy into the platform for easy consumer use. She confessed how nerve-wracking it is trying to produce evermore concise and accessible privacy options, and to wake to a thunder of consumer and press reaction.

Some audience members responded that such anxiety about privacy on the part of an industry is a good thing. One conference aide, Stanford University undergraduate entrepreneur and engineering/physics major Kevin Shutzberg tweeted:

"Are the social media privacy issues about what these websites could do with our data... or about what they are doing with our data?"

Law professor Neil Richards of Washington University commented on the different approaches to privacy in the university, which tends to worry about principles and consumers, and the industry, which is driven by profit:

"Academics tend to ask 'how and in what form should privacy be protected?' while privacy lawyers tend to ask 'how can we do what our client needs to do while still respecting privacy?' Often these questions can end up in the same place... " But the interests differ.

UCLA PhD candidate Luis F. Alvarez-Leon elaborated on the tension between monetization and privacy:

"To me the central concern of the conference -- but also for the immediate future of the digital economy is the balance between economic growth and the consequences of using information as its main commodity."

Panelists from the industry asserted the problem lay more with "third parties" and "rogue apps," who may not comply with social media companies' protocols. From the perspective of the venture capitalists who offered some visions of the industry future on the last panel, privacy issues needed to be solved to insure that new "frontiers" will open and that consumers will have confidence.

"We are living in a world where data is the platform" said David Hornik, of August Capital.

For Saad Khan of CMEA Capital, use of this data is a prime concern.

Stanford University Symbolic Systems major, Reid Spitz, who was fascinated to learn that "venture capitalists are looking for ideas that fundamentally change the way we use the technology that's already available to us," also learned an old lesson anew: "the trust of the users is key."

We walked into the house at 4:30 p.m. on a cold, dark December afternoon.?

The real estate agent fiddled with the lock box for a moment, then cracked open the front door. We kicked off our shoes and stepped in. The floors were cold like a skating rink. We left our overcoats on. The place smelled empty.

?One sec,? the agent said. ?Let me get the lights.?

Click. Nothing. Click. Footsteps. A different switch. Click. Nothing. A pause. More footsteps. ?Maybe it?s this one.? Nothing.

And so began our first experience with the house that was to become our new home. No heat. No lights.?

The funny thing is, we weren?t even looking for a house. We were getting along just fine in our three-bedroom, one-bath; the one we?ve put so much work into fixing up over the last 10 years. But Alicia is pregnant (expecting in July), and we were thinking about trading up to larger house with more space for our growing family. Plus, for a while it had become a bit of a hobby to keep an eye on the neighborhood listings.

Our new house had caught my eye several times before (on our frequent neighborhood walks, houses are a common conversation topic). With a bright red door and an unusual curved front roof, I remember saying ? years ago ? that it could be great if someone would take the time to make it so.

And it had been on the market for months! Everyone who walked through it had hated it. It was a dump. Trashed.?

But finally, in December, on impulse, I called up the listing agent and asked if we could check it out. Alicia humored me, no doubt taking note of the inconvenience in her little book of ?Things Bruno Owes Me For.?

Despite the cold floors and the near-darkness (we actually used cell phone lights until we finally found the one fixture that worked) and the obvious years of neglect, I noticed my heart beating fast, as though I?d just jogged around the block. So when I had that feeling in my chest, I knew we were on to something.?

All signs pointed to no; it was too much work. It had no garage. The electrical system was flawed (to say the least). The furnace was shot. It smelled of cat, and old people, and possibly mice. How could we handle a total house remodel, a toddler, and a new baby all at once?

We left the house and drove the few blocks home without saying much. I looked at my wife and said, ?So, what do you think??

?I like it,? she said.

My heart thumped again. All married people eventually realize there are occasional moments of magic that impress on you how much you love your partner. This was one of them.

?Me too,? I said, grateful I?d chosen to marry someone who?s always up for a big adventure and sees the potential in things, even when most people don?t.

Two months, and hundreds of details later, we had the keys in hand. It was February then; an unseasonably warm, bright afternoon. We walked over to the house and let ourselves in. No need for lights this time; the place was filled with beautiful, long, afternoon sunshine.

And right then, we knew we had made the right choice. We?re in for a world of work, but that doesn?t bother us.?

Because in houses, as in life, there are times when the lights won?t turn on, and things don?t look that great. But you have stop, take a minute, and imagine what they?ll look like when they do.

Because they will.

The folk sensibility is evident within the strong song based formula espoused by Colin Mold, a musician that understands mood, melody and atmosphere by relying on a profound sense of melancholia, as well as the classic instrumentations that bedeck the legendary British progressive folk music scene. Another of those hidden, unknown gems that is always a thrill to discover, Colin is a music teacher, artist, multi-instrumentalist as well as a new member of Karnataka, one of the UK leading proponents of symphonic female vocalist fronted bands. The Welsh band certainly has a following in Europe and is due for some new release soon. If Mold can add the talent displayed here to that endeavor, it will be a monster!

The suave ripples of the sumptuous 'Green and Gold' carry a breathtaking melody that is achingly attractive, with haunting vocals that recall a more robust Peter Sinfield and lyrics that have obvious emotive oomph! And the violin played on ... Such a pleasure when the stringed beast is given the platform to articulate the most stirring of human emotions.

Folk-based songs like 'Chasing Rainbows', 'Blown Away' and the penultimate track 'Realm of the Fire' all reflect the traditional tradition that is so rooted in Welsh, Brit, Scot and Irish culture. The result is always satisfying as there is always a story to be told.

On the epic opus 'View from the Mountain' the true essence of Mold craft comes into the light, velvety melodies egged by vaporous playing seek to entrance and succeeds doing so by adding ripping electric guitar solos that truly coat this piece with that distinct progginess we all pray for. The orchestrations are luxuriant, theatrical and imposing. His vocals recall a sense of grandeur and urgent that is quite addictive. And the violin played on'.. 'Storm Dance' may be the rockiest tune on the album but it's also the best, a whirling dervish rhythm with insistent guitars and Middle Eastern motifs, delicious piano appearing so eloquently, huge waves of string synths colliding in the background, finalized by bold returns to the main guitar-driven chorus, this is really heavenly stuff! Bookended by some storm effects for good measure! Bravo!

The lyrics are meaningful; the singing is in rapture mode, especially on the majestic 'By the Lake' with its colossal highlight reel chorus whilst the music remains mysterious and grandiose. A song that will sear itself to your brain in no time. And to prove that we are in the presence of something sensational, the title track conspires to steal our hearts with an emotional musical outburst that has all the tools, baby! A brilliant folk based song with utterly gorgeous lyrics and sultry singing, the pleading violin in tow'A slithering, misty guitar solo finishes off this stunning piece. I mean WOW!

The exciting epic finale is 'Ancestral Song' and with that ubiquitous title, the mold (excuse the obvious pun!) is set, we are in the presence of a fantastic artist who deserves wider and immediate recognition. Once again we are falling seduced by a wondrous melody, a gorgeous vocal line and sumptuous playing. Yeah, that darn' violin again, bubba! The material has a melancholic vibe, 'on the headstone of history' he sings but the fluid guitar, the powerful voice and the haunting chorus do the rest. Just exemplary music.

Comparisons are near impossible, as the songs are quite unique and original, there are however , for arguments sake, slight vocal hints of Al Stewart, Justin Hayward, Dave Cousins, Iona, early Chris deBurgh, Ian Broudie of 80s pop band Lightning Seeds and musically, Anthony Phillips. The man has a lush voice, not overbearing but that knows how to resonate (like Greg Lake in the late 60s!). What a lovely package indeed!

Japan minister visits nuke plant amid safety worry

TOKYO (AP) - Japan's environment and nuclear minister visited the tsunami-crippled Fukushima Dai-ichi nuclear power plant on Saturday to inspect a spent fuel pool at the center of safety concerns and said it appeared to have been properly reinforced.

The visit by Goshi Hosono, apparently aimed at demonstrating the safety of the facility, came amid renewed concerns about conditions at the plant's No. 4 reactor after its operator reported a bulging of the building's wall. Nuclear regulators ordered a new investigation and seismic tests of the building and its pool.

The building was damaged by an explosion and fire soon after the Fukushima plant was hit by a massive magnitude-9.0 earthquake and tsunami on March 11, 2011. The pool, located at the top of the building above the reactor, remains one of the plant's biggest risks due to its vulnerability to earthquakes.

The plant's operator, Tokyo Electric Power Co., has reinforced the structure and says it now can withstand temblors as strong as last year's quake.

A small group of journalists was allowed to enter the reactor building for the first time with Hosono. Inside were piles of broken wall panels, pieces of cement and mangled equipment, showing the magnitude of the explosion.

Hosono, wearing protective coveralls and a full-face mask, climbed a narrow makeshift staircase to the fifth floor to see the pool, which was covered with a protective tarp. TEPCO officials lifted part of the cover to show the water surface.

He said he was not able to see the newly found 3 centimeter (1 inch) outward bulge in the building's wall with his own eyes, but urged TEPCO "not to take an optimistic view and instead deal with it carefully in order to ensure safety."

Hosono later told reporters that he could see that the pool had been sufficiently reinforced.

"I could see steady progress being made toward removal of the spent fuel (from the pool), which is the next major goal," he said.

The fuel rods in the storage pool are not enclosed as they are in reactor cores and could cause a greater release of radiation in case of a loss of water.

TEPCO is preparing to move the fuel rods from the pool to a joint pool for all six reactors next to the building, but the process won't start until late next year. The joint pool is located on the ground level and is considered safer, even though it already has 6,000 fuel rods in it, officials said. It is expected to take 40 years to decommission the reactors.

Akio Komori, one of the TEPCO executives who escorted Hosono, said the company will inspect the No. 4 building to ensure its integrity while continuing with the fuel removal. Komori, however, rejected growing calls to allow outside experts to inspect the plant's safety.

"As the party with direct responsibility, it's our job to carry out the necessary checks," he said.

From early on, experts have raised concerns about the pool at the No. 4 reactor, where 1,535 fuel rods - the most of any of Fukushima's six reactors - were stored because the reactor was undergoing major refurbishing and the fuel ordinarily inside its core was also kept in the pool.

U.S. nuclear officials feared the fuel rods would overheat and melt as water evaporated from the pool.

The pool had enough water to cover the rods, but officials recently said they might have been saved by chance.

When the disaster struck, two additional pools next to the fuel storage pool had been temporarily filled with water to store equipment used during the refurbishing. That water flowed into the fuel rod pool as its water level declined, though it's not clear whether the rods would have been exposed otherwise, Nuclear and Industrial Safety Agency official Masaru Kobayashi said.

A worst-case scenario envisioned by the head of the Japan Atomic Energy Commission two weeks after last year's accident warned that a melting of the fuel rods at the No. 4 reactor would require the evacuation of 30 million people just from the greater Tokyo area.

Brazil president vetoes part of forest bill

Sao Paulo, Brazil (CNN) -- Brazilian President Dilma Rousseff on Friday vetoed 12 articles of a controversial forest bill approved by Congress last month, which was promoted by the powerful agriculture lobby but slammed by environmentalists.

The legislation updates the complex Forest Code, regulating how much and what kind of land should be maintained as native forest and how much can be cleared for ranching and agriculture.

Rousseff's decision comes less than a month before Rio de Janeiro is due to host a high-profile U.N. summit on sustainable development. Many Brazilians had pushed for a complete veto, staging protests across the county and collecting 1.9 million signatures for a petition.

Instead, Rousseff opted for line-item vetoes of articles that many said would grant amnesty to those who had illegally cleared land.

She vetoed sections that would have eliminated reforestation requirements and sharply reduced the area around water sources that must be maintained as forest.

The Amazon rainforest covers a huge area, roughly half as large as the United States, with about 60% of it in Brazil.

It is estimated that nearly a fifth of the Brazilian forest has been lost since 1970, but over the past decade, authorities cracked down on clear-cutting, reducing the rate of deforestation by 80%.

Former environment minister and presidential candidate Marina Silva has been a loud critic of the bill.

"It's a setback without precedent after the 23 years of progress we've made," she said.

Sen. Katia Abreu, who represents the agriculture and ranching lobby, said the question of reforesting around rivers is more complicated than it appears.

"There are a lot of people who only have a tiny plot of land which is entirely inside the river margins," she said. "What are they going to do with those people? How are they going to reimburse them?"

For years, the Brazilian government encouraged settlers to slash and burn forests in the sparsely populated center, north and west of the country for farming and ranching.

Over three decades, Brazil went from being a food importer to an agricultural powerhouse.

The new Forest Code has been an attempt to reach a compromise for farmers and environmentalists.

(AP) ? Hurricane Bud weakened Friday as it headed toward a string of laid-back beach resorts and small mountain villages on Mexico's Pacific coast south of Puerto Vallarta. Two people, one of them from France, were reported missing in a separate storm in Cuba.

Mexican Authorities canceled school in 11 communities expected to be hit by heavy rains in Jalisco state, and emergency workers prepared emergency shelters, many of them in empty school classrooms.

Heavy rains and 6-foot (2-meter) high waves pelted Melaque, a beach town on the Bahia de Navidad, about 60 mph (100 kilometers) east of the sparsely populated stretch of coast where the hurricane's center was expected to come ashore during the night.

Rafael Galvez, manager of the Hotel Bahia in Melaque, said his staff would to board up windows before Bud's arrival.

"For me, really, this is my fourth hurricane. I went through Wilma in Cancun," which hit as a Category 4, Galvez said. "This is a little less severe."

Category 2 Hurricane Jova hit the area in October, killing six people and flooding parts of Melaque and neighboring Barra de Navidad.

"There was a lot of flooding in the whole area, and we lost electricity," Galvez recalled. But this week, he said, only seven of his hotel's 26 rooms were occupied, and none of the hotel's guests were planning to leave.

A separate storm was pounding much of Cuba and the Bahamas on Friday. Cuba's civil defense agency reported that a French citizen, Alain Manaud, and Silvestre Fortun Alvarez of Cuba were missing after trying to cross rain-swollen rivers, according to the government's Prensa Latina news agency. It said a search for them was continuing.

An official at the French Embassy in Havana said Manaud was 66 and had lived in Cuba for several years. He spoke on condition of anonymity because he was not authorized to comment publicly.

The agency quoted government meteorologists as saying more than 20 inches (500 millimeters) of rain had fallen on parts of the central province of Sancti Spiritus.

The U.S. National Hurricane Center reported that the system had about a 70 percent chance of becoming a tropical or subtropical cyclone.

A hurricane warning was up for Mexico's Pacific coast from Manzanillo, east of Melaque, northwestward to Cabo Corrientes. A hurricane watch and tropical storm warning were in effect from Punta San Telmo westward to east of Manzanillo.

Bud had been a Category 3 storm with maximum sustained winds of 115 mph (185 kph) late Thursday, but it was down to Category 1 force with winds of 75 mph (120 kph) by late Friday afternoon. The U.S. National Hurricane Center in Miami said Bud was expected to weaken further before hitting the coast during the night.

The storm was centered about 80 miles (130 kilometers) west of Manzanillo and moving north near 7 mph (11 kph).

The Hurricane Center said the storm would likely decline to tropical storm-force as it hit land, move a little inland and then make a U-turn and head back out into the Pacific. Rain, rather than wind, could be the big threat, with the Hurricane Center warning of the "potential for life-threatening mudslides" in steep terrain inland.

The government of Jalisco state prepared hundreds of cots and dozens of heavy vehicles such as bulldozers that could be needed to move debris.

Officials in Puerto Vallarta said they were in close contact with managers of the hundreds of hotels in the city in case tourists need to move to eight emergency shelters. It said the sea along the city's famous beachfront was calm, but swimming had been temporarily banned as a precaution.

Jalisco state's civil defense office said two shelters had been opened in Cihuatlan, a town just inland from Melaque that was hard hit by flooding from Jova.

The office also said authorities had decided to open a trench to help drain a coastal lagoon near Melaque that was already full and could overflow.

The region is experienced at handling hurricanes, Galvez noted. "The government planning has helped a lot," he noted.

The last time we heard from SDG Systems, it was shilling its Trimble Nomad with Android 1.5. The company's new device, the RAMPAGE 6 (confusingly, it's also known as the Mesa Rugged Notepad), thankfully includes a less prehistoric build of the OS. The notepad runs a customized version of Android 2.3 on a 5.7-inch display, and it lives up to the "rugged" in its name with IP67 protection ratings for water and dust. Other specs, however, are less heavy-duty: the RAMPAGE 6 packs an 806MHz processor, 256MB of RAM and 4GB of Flash memory. An SD card slot, USB host and client ports, a headphone jack and a 9-pin connector are also on board. The standard model will offer Bluetooth and WiFi, while a Geo configuration adds in GPS and a 3.2MP camera. When the devices launch later this year, SDG will also sell a Geo 3G version, which includes that third connectivity option.
